Where you live decides most of this. Thirty states have legal online betting, three of the biggest do not, and in 2026 the two largest US books started offering sports contracts in those three anyway through a completely different regulator.

Most “best betting sites” pages are a ranked list that ignores the only question that actually determines your options, which is what is legally available where you are standing.

So this page is organised the other way round. Availability first, then what separates the products, then whether the app is any good, then the offshore question.

Where legal betting exists

Thirty states plus Washington DC and Puerto Rico have legal online sports betting as of August 2026: Arizona, Arkansas, Colorado, Connecticut, Delaware, Florida, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Missouri, Nevada, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Rhode Island, Tennessee, Vermont, Virginia, West Virginia and Wyoming.

Two 2026 changes worth knowing. Missouri launched on 1 December 2025 following its voter-approved amendment. Wisconsin legalised on a tribal-exclusive basis in April 2026 but has not launched. Georgia failed again.

The big states still without legal online betting are California, Texas and Georgia, plus Alabama, Alaska, Hawaii, Idaho, Minnesota, Oklahoma, South Carolina and Utah, and several states with retail or tribal betting only.

Two corrections to most published lists

ESPN Bet does not exist. Penn and ESPN terminated the deal early and the app converted to theScore Bet on 1 December 2025, the same day Missouri launched. Any 2026 guide listing ESPN Bet has not been checked. Prime Sports has been in Chapter 11 since November 2025. It is still trading in three states, and its app ratings are the worst in the licensed market at 3.8 on iOS and 2.4 on Android. We would not open an account there.

The three big states, and the loophole that opened in them

This is the biggest change in the US market in 2026 and most guides have not caught up with it.

California, Texas and Georgia have no legal online sportsbook. They now have sports betting products from the two largest US operators anyway, sold as federally regulated event contracts rather than as wagers.

  • FanDuel Predicts launched on 22 December 2025 through a joint venture with CME Group and reached all fifty states within about four weeks, offering sports contracts in eighteen states including California, Texas and Georgia.
  • DraftKings Predictions runs on its own exchange, DKeX, after acquiring Railbird. It received clearance in July 2026 and is reported live in 38 states, again including the three large prohibition states.
  • Kalshi and Polymarket between them took 73.5 percent of all new betting app installs in the first half of June 2026, and went from under 6 percent of the category’s daily active users a year earlier to roughly 45 percent.

Do not read that as settled. The legal position turned sharply against prediction markets between April and August 2026. A federal appeals court ruled for Kalshi against New Jersey in April, then a Utah federal judge granted summary judgment for the state, a New York judge refused the regulator’s emergency motion, a Connecticut judge held that sports event contracts “do not qualify as swaps” and are “sports wagers,” and Washington ordered geofencing by September. Kalshi has agreed to cease operating in Nevada and is geofenced in Michigan.

What that means for you practically

If you live in California, Texas or Georgia, your realistic options in 2026 are a prediction market from a large regulated company, or an offshore sportsbook with no regulator at all. Those are genuinely different risks. The prediction market is federally registered and might be enjoined in your state next month. The offshore book will not be enjoined and also cannot be compelled to pay you.

App quality, honestly measured

We pulled the store ratings directly. The honest finding is that they barely discriminate at all.

Nine of eleven books sit between 4.6 and 4.9, which tells you nothing. In-app rating prompts that fire after a winning bet inflate every one of them. The only real information is in the tails, and even those need reading carefully. Circa’s 2.9 rests on thirteen ratings for a standalone app released in February 2026, which is not a verdict on the sportsbook. Prime Sports at 3.8 and 2.4, from a company in Chapter 11, is a verdict.

BetMGM’s Android score is fragmented across multiple regional listings, so the single figure you will see quoted elsewhere is usually one state’s package rather than the product.

The outage record

This is the app quality measurement that actually matters, and nobody publishes it in a buyer’s guide.

FanDuel has had at least nine tracked incidents since May 2026, including a three hour forty minute login outage on 16 June, a three hour three minute login failure on 8 May, a two hour forty minute stability incident on 15 July, and a one hour forty-nine minute period on 2 May when bets could not be placed at all.

Its worst public incident was Sunday 4 November 2025, an NFL Sunday, with more than 6,000 Downdetector reports. Open bets were inaccessible, cash out broke mid-game and customer service channels went down with the app. FanDuel confirmed all wagers would stand and settle. No refunds or compensation were announced.

DraftKings has 44 or more documented outages since February 2022, including a 53-minute outage on 15 August 2026 attributed to DNS errors. The monitoring service tracking it grades DraftKings F for acknowledgment, with an average of over four hours before any confirmation, and notes that none of the tracked incidents were officially acknowledged on the company’s status page.

What we could not find

No regulator publishes downtime statistics. No operator publishes crash rates. No book has ever been fined for an outage that we could locate. If a book goes down while you have live positions, there is no established remedy, and the November 2025 FanDuel case is the precedent: the bets stand, the cash out you wanted was unavailable, and nothing is owed.

What you are paying, and it is rising

The regulated market has become steadily more expensive for bettors, and the trend is unambiguous.

National hold on US sports betting, per industry reporting of AGA data. Hold is the share of everything staked that the books keep.
PeriodHold
20196.9%
20228.0%
20249.2%
2025 full year10.2%
Q2 2026 to date11.2%, an all-time high

The cause is parlay mix. Parlays hit a record 35.1 percent of handle in January 2026 and produce roughly 60 to 69 percent of operator revenue. In the states that break out bet type, parlays hold about 19.9 percent against 6.0 percent on everything else.

FanDuel disclosed a structural hold of 14.0 percent in Q2 2026, up 40 basis points, and attributed the rise explicitly to same game parlay penetration during the World Cup. BetMGM reported 10.3 percent, up from 9.8.

The practical reading: the sportsbook you use matters less than which products you use inside it. We went through that in what parlays actually cost.

Regulated against offshore

The differences that are real, rather than the ones in the marketing.
DimensionRegulatedOffshore
Recourse Massachusetts ordered DraftKings to pay $934,137 on 27 parlays in December 2025 after the operator tried to void them. Nevada runs formal dispute proceedings. None. Tennessee fined Bovada $50,000 and it is widely reported as unpaid. The fine itself is the illustration.
Your balance Reserve requirements, and a regulator that can compel payment. Prime Sports is in Chapter 11 with customer balances protected, which only happens under a licence. An unsecured claim against a company you cannot name. Two state regulators have told residents in writing to withdraw.
Where it works Geofenced. You must be physically inside a legal state. Works anywhere, but books withdraw from states under pressure. Bovada has exited roughly nineteen.
Tax paperwork W-2G and 1099 forms issued to you and the IRS, with withholding on large payouts. No forms. Your obligation to report is identical, the paper trail is not.
Limiting Aggressive. Massachusetts data showed 0.64 percent of accounts restricted. Massachusetts now requires an explanation. No state bars the practice. Varies enormously, and JazzSports showed in 2025 what limiting can escalate into.
Fees No deposit fees at any major book. Card deposit fees run to 15.9 percent at Bovada, 10 percent on Visa at Bookmaker.eu.
Prediction markets FanDuel and DraftKings both offer them, reaching states where they cannot take bets. No equivalent and no regulatory shelter.
One thing that hits both equally

From tax year 2026 you can only deduct 90 percent of gambling losses against winnings, down from 100 percent. That means you can owe tax in a year you lost money. Three bipartisan repeal bills are pending and none has passed. This applies whether you bet regulated or offshore, and it hits high-volume low-margin bettors hardest. We cover it in what Reddit gets wrong about offshore taxes.

How to actually pick

  1. If you live in a legal state, use a regulated book. The recourse difference is the whole argument and it is not close. The Massachusetts case is what a regulator being able to order payment looks like in practice.
  2. Open more than one. Prices differ enough that shopping is worth real percentage points, and it costs nothing. See what line shopping is actually worth.
  3. Pick on the markets you actually bet, not the app rating. Nine of eleven apps rate between 4.6 and 4.9, so the ratings carry no information. bet365 is the strongest for in-play depth. Circa and Pinnacle price sharpest and are available in the fewest places.
  4. Watch the product mix, not the brand. Parlay hold near 20 percent against 6 percent elsewhere is a bigger lever than which logo is on the app.
  5. If you are in California, Texas or Georgia, understand that your two options carry different risks rather than one being safe. Read the prediction market section again.
  6. If you go offshore, read the counterparty map first. Fourteen brands are about six companies. Best offshore sportsbooks has the detail.
What are the best sports betting sites in 2026?

It depends almost entirely on your state. Thirty states plus DC have legal online betting, and in those states a regulated book is the right answer because a regulator can compel it to pay you. DraftKings has the widest footprint at 27 states plus DC and Puerto Rico, followed by Caesars at 24, BetMGM and Fanatics at 23, FanDuel at about 23, theScore Bet at 20 and bet365 at 17. Circa operates in only six states but prices sharpest.

Which states still do not have legal online sports betting?

The largest are California, Texas and Georgia. Also Alabama, Alaska, Hawaii, Idaho, Minnesota, Oklahoma, South Carolina and Utah, plus several states with retail or tribal betting only. Wisconsin legalised on a tribal-exclusive basis in April 2026 but has not launched. Georgia’s 2026 attempt failed again. Missouri was the most recent launch, on 1 December 2025.

Can I bet legally in California or Texas?

Not with a sportsbook, but FanDuel and DraftKings both now offer federally regulated sports event contracts there. FanDuel Predicts launched in December 2025 through a CME Group joint venture and offers sports contracts in eighteen states including California, Texas and Georgia. DraftKings runs its own exchange and is reported live in 38 states. This is unsettled law though: courts in Utah, Connecticut, New York and Washington all ruled against prediction markets between June and August 2026.

Which betting app is best?

The store ratings will not tell you, because nine of eleven books sit between 4.6 and 4.9 and in-app prompts that fire after winning bets inflate all of them. The only information is in the tails, and even there Circa’s 2.9 rests on thirteen ratings of a brand-new app. Pick on the markets you bet instead. bet365 has the deepest in-play offering, DraftKings and FanDuel lead on player props, and Circa prices sharpest but operates in six states.

Do betting apps go down, and what happens to my bets?

Yes, regularly, and nothing happens. FanDuel had at least nine tracked incidents between May and August 2026, including a three hour forty minute login outage on 16 June. Its worst was Sunday 4 November 2025, an NFL Sunday, with over 6,000 Downdetector reports, cash out broken mid-game and support channels down. FanDuel confirmed all wagers would stand and settle, with no refunds or compensation. DraftKings has 44 or more documented outages since February 2022 and is graded F for acknowledgment. No regulator publishes downtime data and no book has been fined for an outage.

Is a regulated sportsbook actually safer than an offshore one?

On recourse, decisively yes. In December 2025 the Massachusetts Gaming Commission ordered DraftKings to pay $934,137 on 27 parlays after the operator tried to void them. No offshore book has a regulator who can do that. Tennessee fined Bovada $50,000 and it is widely reported as unpaid. Regulated books also charge no deposit fees, while offshore card fees run to 15.9 percent. The trade-offs are geofencing, tax paperwork and generally tighter limits.

Are sportsbooks getting more expensive?

Yes, and quickly. National hold rose from 6.9 percent in 2019 to 10.2 percent in 2025 and hit an all-time quarterly high of 11.2 percent in Q2 2026. The cause is parlay mix: parlays reached a record 35.1 percent of handle in January 2026 and produce roughly 60 to 69 percent of operator revenue, holding about 19.9 percent against 6.0 percent on everything else. FanDuel disclosed a structural hold of 14.0 percent in Q2 2026 and attributed the increase to same game parlay penetration.
