Bet105 is not licensed in any US state. Its Terms of Use exclude no US state either. It turns away the UK, Russia, Ukraine, India, Brazil, Colombia and FATF blacklisted countries, and leaves US legality to you. Federal law targets operators rather than bettors. Washington is the clearest state that makes online betting at an unlicensed book a crime for the player, a class C felony. We found no US regulator letter naming Bet105.
People ask “is Bet105 legal in my state?” The honest answer has three parts, and they are different questions: what the statutes say, what enforcement has actually happened, and where the practical risk sits for someone with money on the site. Bet105’s own pages add a fourth problem. They give conflicting answers about where the book is licensed, who owns it, and which states its US product serves.
For this page we read Bet105’s Terms of Use, General Rules and its “Is Bet105 legal in the US” page. We checked the text of the federal statutes and the state statutes cited below. We also searched the cease and desist records of Michigan, Illinois, Maryland and Massachusetts for any letter naming Bet105. Nothing here is legal advice. If your situation matters, ask a lawyer licensed in your state.

The short answer by state
| Question | Answer | Evidence |
|---|---|---|
| Is Bet105 licensed in any US state? | No | Confirmed Bet105’s own US legality page: licensed “in Anjouan rather than by a state gaming commission” |
| Which US states do Bet105’s terms exclude? | None by name | Confirmed Terms of Use 4.1.9 |
| Is it a federal crime to bet there? | The Wire Act and UIGEA are written for businesses that take bets, not for bettors | Confirmed 18 U.S.C. 1084, 31 U.S.C. 5363 |
| Which state most clearly makes it a crime for the bettor? | Washington, class C felony | Confirmed RCW 9.46.240 |
| Has any US regulator written to Bet105? | None found | Confirmed MI, IL, MD and MA lists checked |
| Does Bet105 geo-block any state? | No published block for the crypto book | Not published |
Where Bet105 accepts you and where it is lawful for you to bet are two different questions. Bet105’s terms answer the first. Your state’s statutes answer the second, and Bet105 says in writing that the second is your problem.
What Bet105’s own terms say
The Terms of Use list the places Bet105 will not take. No US state is on the list.
If you are residing in any of the Restricted Countries or FATF Blacklisted countries, including Russia, Ukraine, India, UK, Brazil and Colombia.
Confirmed Bet105 Terms of Use, clause 4.1.9, retrieved 29 September 2026The same terms put legality on you: “It is your sole responsibility to ensure that your use of the service is legal.” They add that if internet gambling is illegal where you are, “you are not authorized to use your cryptocurrency to deposit on this site.” The General Rules say every transaction is “governed by the laws of Costa Rica” and that Costa Rica residents may not join.
Bet105’s “Is Bet105 legal in the US” page, as we read it on 29 September 2026, matches the terms: “We accept players from around the world,” licensed “in Anjouan rather than by a state gaming commission,” and “it is your responsibility to confirm what is permitted where you live.” It names no excluded state. When we read the same page on 27 September it said something different. It described a “social sweepstakes sportsbook” in “48 states (all except Washington and Utah)” and called the crypto book “Curaçao-licensed.” It has since been rewritten.
A separate page describes a free to play “social sportsbook” that excludes California, Connecticut, Idaho, Louisiana, Michigan, Montana, Nevada, New Jersey and New York. Those exclusions apply to that sweepstakes style product, not to the real money crypto sportsbook, whose terms exclude no US state. Several of those states passed laws against sweepstakes gaming in 2025 and 2026, including California (AB 831), Connecticut (SB 1235), New Jersey (A 5447) and New York (S5935) Reported.
Which product are you actually using?
This page, and our Bet105 review, cover the real money crypto sportsbook at bet105.ag. The social sportsbook page describes a separate free to play product; we did not test it. If Bet105 has signed you up to something it calls a sweepstakes, the rules above may not describe it, and several states now ban dual currency sweepstakes outright.
Federal law: what it covers and what it does not
| Statute | What the text targets | Does it reach the bettor? | Evidence |
|---|---|---|---|
| Wire Act, 18 U.S.C. 1084 | “Whoever being engaged in the business of betting or wagering” uses a wire facility to transmit bets on sporting events | No, by its wording it applies to those in the business | Confirmed statute text |
| UIGEA, 31 U.S.C. 5363 | A “person engaged in the business of betting or wagering” knowingly accepting payments for unlawful internet gambling | No, it targets operators, with blocking duties on banks under 5364 | Confirmed statute text |
| Illegal Gambling Business Act, 18 U.S.C. 1955 | Running an illegal gambling business | Courts have held a mere bettor is not a participant in the business | Reported secondary legal summaries |
None of these makes it a federal crime for an individual to place a bet with an offshore book. They make it harder for the book to operate and to move money, which is why deposits at offshore books are mostly in crypto. In August 2025 a coalition of state attorneys general asked the US Attorney General to use federal tools against offshore gambling, including domain seizures and payment blocking. That letter named no operator.
State law: where the bettor is the offender
Most state gambling laws are aimed at whoever runs the game. A few reach the player. The table separates what we read in the statute text from what we only found in secondary summaries.
| State | Statute | What it says | Classification | Evidence |
|---|---|---|---|---|
| Washington | RCW 9.46.240 | Whoever “knowingly transmits or receives gambling information by … the internet” commits an offence, with authorized sports wagering exempted | Class C felony | Confirmed statute text |
| Indiana | IC 35-45-5-2 | A person who “knowingly or intentionally engages in gambling commits unlawful gambling” | Class B misdemeanor; the internet felony applies to operators | Confirmed statute text |
| Illinois | 720 ILCS 5/28-1 | A person who “makes a wager upon the result of any game, contest” commits gambling, unless the wager is authorized | Class A misdemeanor | Reported text via a legal reproduction, official site did not load |
| Montana | MCA 23-5-151 | “All forms of public gambling … are prohibited” except as authorized | Misdemeanor or felony by amount, per secondary sources | Confirmed prohibition text; penalty tiers Reported |
| Louisiana | R.S. 14:90.3 | “Gambling by computer”, amended by Act 182 of 2026 from 1 August 2026 to cover facilitators and payment processors | Unclear whether the base offence reaches a casual bettor | Confirmed statute text; scope unresolved |
| Connecticut, Tennessee, South Dakota, Oregon, Oklahoma | General gambling statutes | General offences for engaging in gambling | Misdemeanors, per secondary sources | Unverified we did not read these texts |
Washington’s statute is the only one on the list that names the internet and reaches a person who receives gambling information, and it is a felony. Indiana and Illinois make placing an unauthorized bet a misdemeanor in general terms, so betting through a licensed state app is lawful and betting at Bet105 is not. Louisiana’s 2026 amendment is aimed at the businesses and payment processors that make offshore gambling work. Whether its base offence reaches an individual bettor is unresolved.
What has actually happened
Enforcement against offshore sportsbooks in 2025 and 2026 has been aimed at operators. We searched four state lists for Bet105.
| Regulator | Actions checked | Named Bet105? | Evidence |
|---|---|---|---|
| Michigan Gaming Control Board | Cease and desist rounds, April 2025 to April 2026, including 45 operators on 7 April 2026 | No | Confirmed MGCB releases |
| Illinois Gaming Board | Sports wagering cease and desist letters, 2025 to 2026 | No. Heritage Sports, which Bet105’s terms name as owner, was sent a letter on 11 February 2025 | Confirmed IGB letter list |
| Maryland Lottery and Gaming | Illegal operator list, about 130 names, through August 2026 | No | Confirmed MLGCA list |
| Massachusetts Attorney General | Letters of 25 June 2025 | No | Confirmed AG release |
We did not check New Jersey, Pennsylvania, Ohio or Connecticut line by line. General searches there found no letter naming Bet105. The absence of a letter is not permission: letters go to operators a regulator notices, and books that are not named are no more legal than the ones that are. Every cease and desist we reviewed was addressed to an operator. None was addressed to a bettor.
Where sports betting is legal in 2026
If you want a book with a regulator behind it, this is where one exists. The list is as of September 2026. Legal Sports Report agrees on the no legal betting list, though it gives an older count of states.
| Status | States | What it means for you |
|---|---|---|
| Online betting live, 31 states plus DC | AZ, AR, CO, CT, DE, FL, IL, IN, IA, KS, KY, LA, ME, MD, MA, MI, MO, NV, NH, NJ, NY, NC, OH, OR, PA, RI, TN, VT, VA, WV, WY, DC | Licensed apps with a regulator, dispute process and segregated funds. Betting offshore here is betting outside the system your state built. |
| Retail or on premises only, 8 states | MS, MT, NE, NM, ND, SD, WA, WI (online legalized April 2026, not launched) | Legal betting exists but not on your phone at home. Washington is also the felony state above. |
| No legal sports betting, 11 states | AL, AK, CA, GA, HI, ID, MN, OK, SC, TX, UT | No licensed option. Offshore books are the market, and no regulator will help you with one. |
Missouri launched retail and mobile betting on 1 December 2025. Wisconsin legalized online betting in April 2026, but it depends on tribal compact approval and is expected in late 2026 or 2027 Reported.
What Bet105’s licence claims mean
Bet105’s marketing and its binding documents point to different places:
- Anjouan. The licensing page and the US legality page claim a licence “issued in Anjouan, Union of the Comoros.” Neither gives a licence number. Until 27 September the US legality page said “Curaçao-licensed” instead.
- Gaming Services Provider N.V., plus Costa Rica law. The Terms of Use, last updated 1 January 2025, send complaints to “our licensing body, Gaming Services Provider N.V.” The General Rules place every transaction under the laws of Costa Rica.
Gaming Curaçao says every sub-licence under Gaming Services Provider N.V. expired on 18 August 2024. Anjouan publishes a gaming licensing and supervisory framework, but without a licence number we could not match Bet105 to an entry. So the accurate statement is that we have not verified a current licence covering this operator and this domain.
None of these would make Bet105 legal in any US state. A licence from Anjouan or Curaçao, where valid, governs the operator’s conduct in that jurisdiction. It does not override US state law, and Bet105’s own licensing page says so: its licence “does not override the rules where you live.” For a US bettor, what a verifiable licence would give you is a named company and a regulator you could complain to. Bet105 currently offers neither in a form we could verify. The full analysis is in our Bet105 review.
Where the real risk is
For most bettors the realistic risk at Bet105 is not prosecution. It is being on the wrong side of a dispute with nobody to appeal to:
- No state regulator. None has authority over your account.
- Short deadlines and a low cap. The terms give you three days to dispute a graded bet and cap Bet105’s liability at the lower of your stake or $500.
- No chargebacks. Crypto deposits cannot be reversed.
- Dormant balances. The General Rules forfeit balances on accounts inactive for 365 days.
- Documents on demand. The terms let Bet105 ask for ID, proof of address, a selfie or a call before any withdrawal, whatever the homepage says about KYC.
Taxes
Bet105’s General Rules say it “does not report any winnings or losses to any government agency” and “does not withhold taxes.” In the US, gambling winnings are taxable income whether or not the book reports them. Bet105’s account history only shows the past two weeks, so keep your own record of every deposit, wager and withdrawal. This is not tax advice.

Common questions
Is Bet105 legal in the US?
Bet105 is not licensed in any US state; its own US legality page says it is licensed in Anjouan rather than by a state gaming commission. Federal law, the Wire Act and UIGEA, is written for businesses that take bets rather than for bettors. Whether you personally may bet there depends on your state’s statutes. Washington makes it a felony, and Indiana and Illinois make unauthorized betting a misdemeanor. This is not legal advice.
Which states does Bet105 not accept?
Bet105’s Terms of Use exclude no US state by name. They exclude residents of restricted and FATF blacklisted countries, including Russia, Ukraine, India, the UK, Brazil and Colombia, and put the responsibility for legality on you. A separate free to play social sportsbook page excludes nine states, but that applies to the sweepstakes style product, not the real money crypto sportsbook.
Is it illegal to bet at Bet105 in Washington?
Washington’s RCW 9.46.240 makes it a class C felony to knowingly transmit or receive gambling information by the internet, with an exemption for sports wagering the state has authorized. Bet105 is not authorized in Washington, so that exemption does not cover it. Washington is the clearest example of a state where the bettor, not only the operator, is the offender. This is not legal advice.
Has any state sent Bet105 a cease and desist letter?
We found none. We checked the Michigan Gaming Control Board’s cease and desist rounds through April 2026, the Illinois Gaming Board’s letter list, Maryland’s list of about 130 illegal operators through August 2026, and the Massachusetts Attorney General’s 2025 letters. Illinois did write to Heritage Sports in February 2025, and Bet105’s Terms of Use name Heritage Sports Group as owner. The absence of a letter does not make a book legal.
Where is Bet105 licensed?
Its own documents disagree. The licensing page and US legality page claim an Anjouan licence with no number; the US page said Curaçao until late September 2026. The Terms of Use name Gaming Services Provider N.V., whose sub-licences Gaming Curaçao says expired in August 2024. The General Rules say transactions are governed by Costa Rica law. We have not verified a current licence covering this operator and domain, and none of these would license Bet105 in any US state.
Do I have to pay tax on Bet105 winnings?
In the US, gambling winnings are taxable income whether or not the book reports them. Bet105’s General Rules say it does not report winnings or losses to any government agency and does not withhold taxes, so reporting is on you. Its account history only covers the past two weeks, so keep your own records of deposits, wagers and withdrawals. This is not tax advice.
